Judicial Activism in an Age of Populism
This special issue explores the range of meanings attributed to the terms 'judicial activism’ and 'populism’ and, in the context of specific contemporary case law, examines the interplay between these two phenomena.
The central question asked in this special issue is 'To what degree and how does populism –whether of the left or the right-impact judicial decision-making in the democratic societal context in specific legal cases and what are the implications for the integrity, independence and role of the judiciary.
