The Brazilian Journal of International Law invites submissions for a special issue on “Challenging the International Law of Immunities: New Trends on Established Principles?” to be published in March 2021. The issue will be edited by Lucas Carlos Lima (Universidade Federal de Minas Gerais), Loris Marotti (Università degli Studi di Milano) and Paolo Palchetti (Sorbonne Law School). The deadline for submission is the 20th of October 2020.

Immunities in international law are constantly subject to attempts of normative challenge, contestation and overhauling, in spite of recent reaffirmations of their core principles by national and international tribunals. This tension can be perceived as a cross-cutting trend in the permanent questioning of rules of immunities pertaining to different international actors such as States, International Organizations, Heads of States and diplomatic agents. Not by chance the narratives involving this field of law can be chronicled in sagas (Pinochet, Germany v. Italy, Mothers of Srebrenica, Jam v. IFC, Changri-la submarine, etc.) which do not rarely intermingle municipal, regional and international legal orders.

The purpose of the current special issue of the Brazilian Journal of International Law is to discuss new trends and emerging challenges to the international law of immunities. The idea is to map the attempts to reconcile a more state-centric approach with the novel challenging elements stemming from values which underpin different fields, and particularly human rights law and international criminal law. The issue is not purported to constitute an organic work but rather a bricolage of different practices, perspectives and analyses of the current trends on the different branches of immunities. Thus, the Editors, aware of the broadness of the topic, are particularly interested in receiving contributions dealing with recent challenge, contestation or reassertion of the principles involving the international law on immunities.

The following non-exhaustive topics can be considered by interested authors and researchers.  Current developments in the law of immunities from jurisdiction and execution covering State immunity, immunities of international organizations, immunities of State officials.  The role of international and municipal courts in developing and challenging the law of immunities.  Theoretical approaches to the law of immunities.  Regional and municipal approaches to the law of immunities.
